Terms of sale
Last updated: October 16, 2026
These General Terms and Conditions of Sale (the "Terms") govern orders for personalised photo albums placed on the Everbook website, available at everbook-album.com (the "Site"), operated by EFFET DESIGN, registered with the Lebanese commercial registry under number 1015439, with its registered office at Achrafieh, building 5134, Sioufi Street, Lebanon (the "Company"). By placing an order on the Site, the customer acknowledges having read these Terms and accepts them. The Site uses artificial intelligence tools to help the customer select, organise and/or lay out their photographs (see article 4). The use of these tools is presented to the customer transparently and does not affect their right to approve, change or reject any suggestion before their album is printed. This is an English translation of the French Conditions Générales de Vente. In case of any discrepancy, the French version prevails.
1. Purpose
Through the Site, the Company offers a service allowing users to select and upload their photographs, customise the layout of a photo album, where applicable with the help of artificial intelligence tools, order its printing and receive the printed album at the delivery address given when ordering, or order its digital version (PDF). Albums are made to order according to the choices the customer makes when customising their album, as finally approved by them. Printing and, where applicable, all or part of the manufacturing or delivery may be carried out by partner providers selected by the Company, in particular a partner printing house located in Lebanon.
2. Scope
These Terms apply to any order placed on the Site by a consumer. They are available to the customer before their order is finally confirmed. Ordering on the Site is reserved for persons with the legal capacity to enter into contracts. By ordering, the customer declares that they are of legal age in their country of residence or, failing that, are acting with the authorisation of their legal representative. The Company reserves the right to change these Terms. The version that applies to an order is the one accepted by the customer when confirming that order. When the customer orders from a country other than Lebanon, any mandatory consumer-protection provisions of their country of habitual residence remain applicable, in accordance with article 22.
3. Creating and customising the album
The Site allows the customer to create a personalised photo album from the photographs they select and upload to the platform. Depending on the options offered on the Site, the customer may choose in particular: • the photographs included in the album; • their order and arrangement; • the album format; • the number of pages; • the cover; • the layout; • texts and other customisation elements; • and any other option offered on the Site. The customer is responsible for checking their album before finally confirming their order, including where all or part of the selection or layout results from a suggestion generated by an artificial intelligence tool. In particular, it is up to the customer to check the selected photographs, their orientation, framing and order, the inserted texts, spelling, the number of pages and the other customisation choices. The digital representation of the album shown on the Site is a preview. Slight differences may exist between this preview and the printed product, notably in colours, brightness, contrast, framing or rendering, due in particular to the characteristics of screens, of the files provided and of the printing process. Such differences are not a product defect when they remain within normal printing tolerances.
4. Artificial intelligence assistance
The Site may offer the customer features based on artificial intelligence tools, in particular to suggest a selection of photographs, an order, a layout or elements of the album's composition. These features are an aid to creation. They do not replace the customer's choice: the customer can at any time change, complete or discard the suggestions made by these tools before finally confirming their order, in accordance with article 3. The Company cannot guarantee that the suggestions generated by these tools fully match the customer's aesthetic or personal expectations. It is up to the customer to check the final result before printing. Unless the customer gives express and separate consent for this purpose, the photographs uploaded by the customer are not used to train, retrain or improve artificial intelligence models intended for any use other than processing the current order. How these tools process photographs is detailed in the Privacy Policy. The layout or composition elements generated by the Site's artificial intelligence tools from the customer's choices may be used freely by the customer in their album; for the rest, they remain governed by article 18 on the Site's intellectual property.
5. Quality of photographs
The quality of the printed product depends in particular on the quality and resolution of the files provided by the customer. When the Site indicates that a photograph has insufficient resolution or may lead to reduced print quality, a customer who nevertheless decides to keep that photograph accepts the corresponding risk. The Company cannot be held liable for a quality defect directly attributable to a file of insufficient quality provided or approved by the customer. This provision does not limit the Company's liability for a defect resulting from the printing process itself.
6. Content uploaded by the customer
The customer remains the owner of the photographs and other content they upload to the Site. Uploading content to the Site does not transfer any intellectual property to the Company. However, for the time strictly necessary to fulfil the order, the customer grants the Company a limited authorisation to use, reproduce, store and transmit the files concerned, including, where applicable, through the tools described in article 4, solely in order to create, print, check, manufacture and deliver the ordered album. The Company may not use the customer's photographs for advertising, commercial or promotional purposes, nor to train artificial intelligence models other than as described in article 4, without the customer's prior, free and express consent.
7. Rights to photographs and content
The customer declares that they hold the rights and authorisations needed for the photographs, texts and other content they provide on the Site, including, where applicable, the consent of people recognisable in the photographs or, for minors shown in them, of their legal representatives. In particular, the customer undertakes not to upload content that infringes intellectual property rights, image rights, privacy or any other right belonging to a third party. The customer also undertakes not to use the service to create content that breaks the applicable laws. The customer indemnifies the Company against any claim, action or judgment resulting from a breach of the declarations and undertakings in this article, to the extent permitted by the applicable law. The Company reserves the right to refuse or cancel an order when it finds that content is manifestly unlawful or that printing it would be prohibited by law. In that case, the financial consequences of the cancellation will be determined according to how far the order has progressed and the applicable mandatory legal provisions.
8. Order
Before ordering, the customer can view a preview of their album and the main characteristics of the selected product. The customer is invited to check and, where needed, correct their order before finally confirming it. The order becomes final after: • the customer has checked the order summary; • these Terms have been accepted; • the order has been confirmed; and • payment has been confirmed, when it is required immediately. An order confirmation is sent to the customer electronically at the address given when ordering. The Company reserves the right to refuse an order, in particular in the event of refused payment, suspected fraud, technical impossibility of manufacturing or manifestly unlawful content.
9. Approval of the file before printing
By finally approving their album, the customer confirms that the version shown, including any elements resulting from an artificial intelligence suggestion they accepted or changed, is the version they want printed. After this approval, and once the order has been sent to production, the customisation elements can in principle no longer be changed. Any change requested after approval will be considered by the Company, with no guarantee that it can be made.
10. Prices
The applicable prices are those shown on the Site at the time of ordering. Prices are shown in USD, all taxes included. Before confirming the order, the customer is informed of the total price of their purchase, including the price of the album, any options chosen, applicable taxes and delivery costs. Delivery within Lebanon costs USD 5 per order. The digital album costs USD 25, whatever its format and number of pages, with no delivery costs. The Company may change its prices at any time. A later price change does not, however, affect an order already confirmed.
11. Payment
Payment is made in cash or by bank card, using the payment methods shown on the Site at the time of ordering. Payment may be processed by a third-party payment provider. The Company does not intend to keep the customer's full card details when payment is processed directly by that provider. The order may be suspended or cancelled if payment is refused or fails.
12. Manufacturing
As albums are personalised from the customer's choices and photographs, their manufacturing starts after the order has been confirmed and payment has been confirmed. The Company may entrust the printing and manufacturing of the album to a partner printing house located in Lebanon. Using a provider for printing does not change the consumer's rights towards the Company where the Company acts as the contractual seller of the album.
13. Delivery
Delivery is currently available in Lebanon only. Products are delivered to the address given by the customer when ordering. The customer is responsible for the accuracy and completeness of the delivery information they provide. The available delivery areas and the corresponding costs are shown on the Site before the order is confirmed. The estimated manufacturing and delivery time is shown to the customer before or when ordering. As a guide, manufacturing takes about 3 days and delivery 2 to 3 days. The announced times may be affected by circumstances beyond the Company's control. In the event of a significant delay, the customer's rights are those provided by the applicable mandatory provisions of Lebanese law.
13 bis. Digital album (PDF)
The customer may order their album in digital form: a PDF file containing the album's cover, pages and back cover, in screen quality. This file is neither printed nor delivered. The file is made available in the customer area ("My orders") once payment has been confirmed; the customer is informed by email. It remains downloadable, as many times as wished, for as long as the customer's account exists. It is the customer's responsibility to keep a copy of it. The customer may later order the printed version of the same album; the amount paid for the digital album is then deducted from the price of the printed album.
14. Receipt – Damaged or non-conforming product
The customer is invited to check the condition of their parcel and album on receipt. If the album is damaged, has a printing defect or does not match the approved order, the customer is invited to contact the Company within 14 days of receipt at orders@everbook-album.com, giving their order number and, where possible, photographs showing the problem. Where a defect or non-conformity is attributable to the Company or one of its providers, the Company will offer, depending on the circumstances and in accordance with the applicable law, a reprint, replacement, repair or refund of the product concerned. This provision does not limit any mandatory right the consumer has under Lebanese law.
15. Cancellation and right of withdrawal
The albums offered on the Site are made to order from the customer's photographs, format, layout and other individual choices, including when these choices result in whole or in part from an artificial intelligence suggestion accepted by the customer. Law no. 659/2005 on consumer protection grants consumers, for distance purchases, a right to cancel within ten (10) days, excluding in particular personalised or made-to-order goods (article 55 of Law no. 659/2005). The album ordered on the Site, made from the customer's own photographs and choices, falls under this exclusion. Consequently, the right of cancellation that applies by law to distance sales cannot be exercised by the customer for the personalised album once the order has been confirmed under the conditions of article 8. The customer may nevertheless ask to cancel their order before manufacturing starts by contacting the Company at orders@everbook-album.com. The Company will make its best efforts to stop the order. Cancellation cannot, however, be guaranteed once manufacturing has started. This article does not deprive the customer of their rights when a product is defective, damaged or does not match the order. For the digital album, a personalised content supplied in digital form, the order can no longer be cancelled once the file has been made available to the customer.
16. Personal data and photographs
When the Site is used and orders are fulfilled, the Company may process in particular: • the customer's identification data; • their contact details; • their delivery address; • information about their orders; • the photographs and other files they upload, including, where applicable, images of identifiable individuals or minors; • the information needed for payment, within the limits required for the transaction. This data is processed in accordance with the applicable Lebanese legislation, in particular Law no. 81/2018 on electronic transactions and personal data. Uploaded photographs are used only to the extent necessary to provide the service, unless the customer expressly consents to another use. Given the particular nature of some photographs (in particular when they show identifiable people or minors), the Company applies appropriate security and confidentiality measures. It does not use these photographs for facial recognition: automatic face detection is used only to frame photographs in the layout, without ever identifying the people shown. Some data and photographs may be sent to the providers involved in fulfilling the order, in particular the printing house and, where necessary, the delivery provider. These providers must only receive the information needed to carry out their tasks. Detailed information on the collection, use, retention, sharing and deletion of personal data is given in the Privacy Policy available on the Site.
17. Retention and deletion of photographs
Uploaded photographs are kept according to the following rules: • album not ordered: it is automatically deleted, with its photographs, 30 days after it was created; • unused photographs: photographs uploaded but not included in the final layout of an ordered album are deleted once the order's print file has been generated; • ordered album: the album, its photographs and the order history are kept for as long as the customer's account exists, to allow a reprint, to let the customer find their album again, or to handle any complaint. The PDF file of a digital album is kept for as long as the customer's account exists. The customer can delete their account at any time from their account page ("Delete my account"): their account, albums and photographs are then permanently deleted. Information about past orders (amount, delivery address) is kept for accounting purposes, without any photograph. Deletion is not possible while an order is being manufactured or delivered. The customer may also ask for their photographs to be deleted earlier once keeping them is no longer necessary to fulfil the order or to handle an ongoing complaint, as described in the Privacy Policy.
18. Intellectual property of the Site
The Site, its software, interface, graphic elements, layout templates, brand, logo, the artificial intelligence tools it uses and the other elements created by or for the Company are protected by the applicable intellectual property rights. Nothing in these Terms grants the customer any ownership of these elements, except the right to use, in their album, the layout suggestions generated from their own content in accordance with article 4. This provision does not affect the rights of the customer or of third parties in the photographs and content uploaded by the customer.
19. Liability
The Company is responsible for performing its obligations in accordance with the applicable law. However, it cannot be held liable for a defect resulting solely from: • a photograph or file of insufficient quality provided by the customer; • an error in text, selection, framing or layout approved by the customer, including when that error was already present in a suggestion generated by an artificial intelligence tool that the customer accepted without correcting it; • an incorrect delivery address provided by the customer; • use of the service contrary to these Terms or to the law; • or a force majeure event within the meaning of the applicable law. Nothing in these Terms excludes or limits any liability that cannot legally be excluded or limited under Lebanese law.
20. Force majeure
Neither party can be held liable for a delay or failure to perform resulting from a force majeure event recognised as such by Lebanese law. The party concerned informs the other party within a reasonable time of the event and its foreseeable consequences for the order. If the impediment lasts so long that the order can no longer reasonably be fulfilled, the consequences of ending the contract are determined in accordance with the applicable law.
21. Customer service and complaints
For any question or complaint about an order, the customer can contact the Company: Email: orders@everbook-album.com The customer is invited to give their order number so that their request can be handled more easily.
22. Applicable law
These Terms and the orders placed through the Site are governed by Lebanese law. Where the customer is a consumer habitually resident in a country other than Lebanon, the choice of Lebanese law cannot deprive them of the protection afforded by the mandatory provisions of the law of their country of residence that cannot be derogated from by contract.
23. Dispute resolution
In the event of a dispute, the customer is invited to first contact customer service to seek an amicable solution. Failing an amicable settlement, the dispute will be submitted to the competent courts in accordance with the rules of jurisdiction applicable under Lebanese law. Nothing in this article can deprive a consumer of a mandatory rule of jurisdiction from which they benefit, in particular, where applicable, that of their country of habitual residence.
24. General provisions
If any provision of these Terms is declared void, unlawful or unenforceable, the other provisions remain applicable to the fullest extent permitted by law. The Company's failure to exercise immediately a right under these Terms does not constitute a waiver of that right. These Terms, together with the order confirmation and the other contractual documents expressly incorporated, form the agreement applicable to the order between the Company and the customer. These Terms are written in French and translated into English. In case of any discrepancy between the two versions, the French version prevails.
